The Holt County Board of Supervisors met as a Board of Equalization with all members present. County Assessor Tim Wallinger, County Treasurer Shelley Ross and County Clerk Kathy Pavel were also in attendance. This meeting has been published pursuant to Section 84-1411 RRS 1943. Notice of the meeting has been given in advance by publication in the paper as shown in the Affidavit of Publication dated October 20, 2022 in the Holt County Independent.

Chairman Fram called the meeting to order at 9:30 a.m. with a flag salute.

Motion by Keyes, 2nd by Butterfield to approve the minutes of the October 14, 2022 meeting as printed. Voting: Treptov, Keyes, Butterfield, Breiner, Paxton, Thielke and Frahm. Vote against: none. Transferred motion.

Chairman Fram convened a public hearing at 9:31 a.m. to receive public comment on the proposed vehicle tax exemption application for: Community Enrichment Building Blocks for a 2013 Chevrolet Impala; Good Samaritan Society – Atkinson in a 2009 Ford Cutaway van; West Holt Memorial Hospital in a 2001 Ford Ranger. No one came forward to comment.

Motion of Butterfield, 2nd Treptow, to approve corrections to Tax Roll #21-031 filed by Assessor. Voting: Keyes, Butterfield, Breiner, Paxton, Tilke, Treptow and Fram. Vote against: none. Transferred motion.

Motion of Butterfield, 2nd Paxton, to approve request for approval of later homestead exemption application on lot #450064200. Voting: Butterfield, Breiner, Paxton, Thielke, Treptow, Keys and Fram. Vote against: none. Transferred motion.

The Holt County Board of Supervisors met for regular session after adjournment with all members present. This meeting has been published pursuant to Section 84-1411 RRS 1943. Notice of the meeting has been given in advance by publication in the paper as shown in the Affidavit of Publication dated October 20, 2022 in the Holt County Independent.

Chairman Tilke convened the meeting at 9:45 a.m. and informed the public about the location of the open meeting poster.

Motion by Fram, 2nd Paxton to approve the minutes of the October 14, 2022 meeting as printed. Voting: Treptov, Keyes, Butterfield, Breiner, Paxton, Fram and Thielke. Vote against: none. Transferred motion.

The announced time of 9:50 a.m. was allowed for public comment. Grace Coleman spoke on election security and Ben Fuller and Robert Latimer of Turn Key Logistics representing Summit Carbon Solutions reported on the proposed CO2 pipeline in Holt County.

The commission considered the claims in the case.

Motion by Paxton, 2nd Keyes to approve Tammy Heiser as manager of the Atkinson/Stewart Country Club. Voting: Keyes, Butterfield, Breiner, Paxton, Fram, Treptow and Thielke. Vote against: none. Transferred motion.

Motion by Paxton, 2nd Butterfield to approve the application for a special liquor license for the O’Neill Chamber of Commerce for the Shamrock Nursery Open House on November 11, 2022. Voting for: Butterfield, Brainer, Paxton, Fram, Treptow, Keyes and Tilke. Vote against: none. Transferred motion.

Steve Anson and Mary Reiser of Anson Insurance were present to discuss workers’ comp life insurance.

Motion by Fram, 2nd by Keyes, to add to the benefits package a $25,000.00 double benefit life insurance policy at $4.75 per month for eligible employees with Beam coverage through Anson Insurance effective January 1, 2023 . Voting for: Breiner, Paxton, Fram, Treptov, Keys, Butterfield and Thielke. Vote against: none. Transferred motion.

Jeanne Conziemius of Meritain Health Insurance was present to discuss with the Board the renewal of the employee health insurance program.

Motion by Keyes, 2nd Fram to accept the continuation of employee health insurance with Meritain Health Insurance and to retain the $50,000.00 self-insurance and to continue the Teledoc coverage option for all members and to renew the administrative fee for 2 years. Voting for: Paxton, Frahm, Treptov, Keys, Butterfield, Breiner and Thielke. Vote against: none. Transferred motion.

Motion by Frahm, 2nd by Keyes to authorize direct deposit of wages and other related claims. Voting YES: Frahm, Treptow, Keys, Butterfield, Breiner, Paxton and Thielke. Vote against: none. Transferred motion.

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

Because: Nebraska Statutes Sections 39-2302 and 39-2501 through 39-2505 detail the requirements that must be met in order for a county to be eligible to receive the annual incentive payment; and

Because: The Nebraska Department of Transportation (NDOT) requires each county to certify annually (by December 31st of each year) the appointment(s) of County Highway Superintendent(s) to NDOT using the County Highway Superintendent’s year-end certification Form; and

Because: NDOT requires that such certification also include a copy of the District Highway Superintendent’s appointment documentation, i.e. the minutes of the meeting showing the appointment of the District Highway Superintendent in their name as it appears on their license (if applicable), license number (if applicable) and the class of license (if applicable), the type of assignment, i.e., employed or contracted (consultant or long-distance agreement with another county and/or municipality), and the date the assignment began; and

Because: NDOT also requires that such Annual County Highway Superintendent Certification form be signed by the County Board Chair and include a copy of the Board Resolution authorizing the signing of the Annual County Highway Superintendent Certification form. chairman of the district council.

Let it be resolved that the Chairman of the County Board of Holt County is hereby authorized to sign the attached form(s) for the year-end Certification of County Superintendent of Highways.

Voting: Keyes, Butterfield, Breiner, Paxton, Fram, Treptow and Thielke. Vote against: none. Transferred motion.

Motion by Fram, 2nd from Paxton, to direct the county clerk to certify the road mowing fees to the county treasurer for collection, as presented by the road superintendent. Voting: Butterfield, Breiner, Paxton, Frahm, Treptow, Keyes and Tilke. Vote against: none. Transferred motion.

Road Superintendent Gary Connaught presented a report on the department’s activities.

UNL Extension faculty members Amy Timmerman and Jay Jenkins were on hand to update Extension.

At 11:50 a.m. Motion by Fram, second by Paxton, to go into closed session to discuss the recommendation of the attorney representing Holt County regarding the lawsuit filed by Rick Hill, naming County Clerk Kathy Pawel along with numerous other county officials and public employees. Voting for: Breiner, Paxton, Frahm, Treptow, Keys, Butterfield and Thielke. Vote against: none. Transferred motion.

Members of the collegium, the prosecutor and the secretary of the district were present at the closed meeting.

At 12:01 p.m., motion by Keyes, 2nd motion by Butterfield to adjourn in closed session and resume open session. Voting for: Paxton, Frahm, Treptov, Keys, Butterfield, Breiner and Thielke. Vote against: none. Transferred motion.

Chairman Thielke stated that the only matter discussed in closed session was the ongoing litigation.

Motion by Breiner, 2nd Keys to approve joint defense agreement and to approve joint representation of the county by counsel provided by the county’s insurance company, EMC Insurance Companies, and certain other county clerks also named as defendants in the case. suit brought by Mr. Hill. Voting YES: Frahm, Treptow, Keys, Butterfield, Breiner, Paxton and Thielke. Vote against: none. Transferred motion.

The Council adjourned for lunch at 12:16 p.m

Chairman Thielke resumed the meeting at 13:25. Due to the large turnout, Chairman Thielke moved the meeting to the Holt County Board Room.

Chairman Thielke opened the public hearing at 1:46 p.m. He stated that it would be one hearing with 3 topics/amendments. 3 amendments relate to CO2 pipelines, solar energy and updated wind farm regulations.

Speaking on the CO2 pipeline amendment were: Robert Randall, Diana Steskal, Jesse Walmer of Green Plains, Seth Harder of Husker Ag, Brent Neese of Summit Carbon Solutions, Bernard Anderson, Cheryl Winkler, Mary Katzor. Mary Katzor explained that the solar regulations are new regulations to the Holt County Planning and Zoning Regulations. Speakers on wind regulations included Kate May, Dave Wright, Invenergy’s Ned Porter, Rod Heiss, Bill Katsor, Dave Sehi, Steve Boshart, Mary Katsor, and Wayne Kaup.

Motion by Fram, 2nd by Paxton, to adjourn the public hearing at 4:26 pm and return to regular session. Voting: Treptov, Keyes, Butterfield, Breiner, Paxton, Fram and Thielke. Vote against: none. Transferred motion.

Fram’s motion to accept all recommendations made by the Planning and Zoning Board with 1 change to the carbon pipeline recommendation, change 400 feet back to include the wording unless otherwise agreed to by both parties. And one wind farm change to change 6,000 feet back to 5,280 feet, or one mile. This movement froze for less than a second.

Motion by Keyes, second by Breiner, to table all 3 recommendations for further consideration until next meeting, November 16, 2022. Voting for: Keyes, Butterfield, Breiner, Paxton, Frahm, Treptow and Thielke. Vote against: none. Transferred motion.

Chairman Tilke adjourned the meeting at 4:45 p.m. until November 16, 2022 at 9:45 a.m.
